OrO Gym Moraira – Terms of Service

Article 1: Membership Fees and Payment

1.1 Payment for membership at OrO Gym Moraira is due in advance and is made via direct debit.1.2 In the event of a payment delay of four weeks, access to OrO Gym’s activities will be suspended until full payment has been made.1.3 If a member is in default of payment obligations after eight weeks, the claim will be transferred to a collection agency. All additional costs, including statutory interest on the overdue membership fee, are for the account of the member or their legal representative if the member is a minor.

Article 2: Fulfillment of Payment Obligations

2.1 OrO Gym reserves the right to terminate the membership in the event of non-payment, in accordance with the set conditions.2.2 In the case of termination due to non-fulfillment of payment obligations, the member is immediately denied access to the facilities.

Article 3: Membership Duration and Obligations

3.1 At the start of the membership, the member commits to the full duration of the membership and the associated payment obligations.3.2 The membership fee is also due if the member temporarily cannot use the facilities of OrO Gym, regardless of the reason for absence.

Article 4: OrO Gym’s Best-Efforts Obligation

4.1 OrO Gym commits to providing a diverse and complete range of sports activities on-site during OrO Gym’s opening hours as published on the OrO Gym website.

Article 5: Suspension of Payment Obligation & Flex Rate

5.1 Suspension of the payment obligation for non-flex subscriptions is only possible based on a written agreement by OrO Gym’s management or by presenting a valid medical certificate.5.2 In case of medical absence, the membership period is extended by the duration of the absence.5.3 With a flex rate, members may end their subscriptions at any time with a 14-day notice period before the start of the next payment obligation period.5.4 Flex members may either end their entire subscription with the aforementioned 14-day notice period or opt to “freeze” the monthly subscription main fee for a maximum of 3 months per calendar year. When opting for a freeze period, the main fee will not be charged after the notice period for a maximum of three payment periods. Only the freeze fee will continue to be charged during this period to protect the member’s original discounted rates and perks. Upon expiration of the maximum allowed three months, the main fee will again be charged unless the member has fully terminated the flex membership in a timely manner according to the Terms of Service. If a flex member fully terminates the membership, a registration fee may apply in case of rejoining OrO Gym in the future.

Article 6: Age Restrictions for Membership

6.1 Persons under the age of 18 cannot enter into an independent membership with OrO Gym. Memberships are only available to those aged 18 and over.6.2 For persons under the age of 18, memberships can only be obtained in conjunction with a membership from a parent or legal guardian, who will act as the official contracting party. The parent or guardian is responsible for all activities and obligations of the minor member.

Article 7: Duration and Termination of Membership

7.1 After the agreed duration expires, the membership automatically continues for an indefinite period. Termination is then possible with a notice period of four weeks prior to the next payment obligation, except for Flex memberships that have a 14-day notice period.7.2 Termination must be done with respect to the four-week notice period before the end of the agreed duration. If termination is not timely, the membership will be terminated in accordance with the applicable notice period.7.3 In the case of early termination of a 2-year membership, any benefits compared to the 1-year membership, as well as unpaid registration fees, will still be charged.7.4 Termination of the membership must be done digitally via  info@oro-gym.com  or, if the registration took place online, via the cancellation form on the OrO Gym website.7.5 Vacation, residence, or education abroad do not constitute valid reasons for termination of the membership before the end of the agreed term.

Article 8: OrO Dedicated App

8.1 Upon registration, each member receives access to our digital app.8.2 Access to our facilities is granted by scanning the QR code with the app.8.3 Members can load a monetary amount onto the entrance band to be used for purchases within OrO Gym. This credit can only be topped up via debit card payment. Refund of the remaining credit upon termination of the membership is not possible.

Article 9: Use of the Locker

9.1 Lockers are intended for storing personal belongings. Storing dangerous, illegal, or perishable goods is prohibited.9.2 Management reserves the right to inspect lockers if there is suspicion of a violation of the conditions.9.3 Lockers can only be used during OrO Gym’s opening hours and must be emptied before closing. OrO Gym reserves the right to open and store items from lockers that were not emptied in time. OrO Gym will store these belongings for a maximum of 7 days.

Article 10: Maintenance and Liability (Lockers)

10.1 Users of lockers are responsible for the maintenance of the rented locker and must report any damage immediately to OrO Gym.10.2 OrO Gym accepts no liability for loss, theft, or damage to property stored in the lockers.

Article 11: Changes to the Terms and Conditions

11.1 OrO Gym reserves the right to amend these general terms and conditions at any time. Any changes will be communicated to members in advance.

Article 12: Medical Freeze

12.1 If sports activities are temporarily impossible due to medical conditions, OrO Gym offers the possibility to freeze the membership.12.2 A valid medical certificate is required to freeze the membership on medical grounds.12.3 The medical freeze can be requested for a minimum of 2 periods (8 weeks) up to a maximum of 10 periods (40 weeks). This period will be added to the original membership duration.

Article 13: Indexation

13.1 OrO Gym reserves the right to adjust the membership fees in the interim as a result of economic developments, including but not limited to adjustments in sales tax, increases in operating costs, and annual price indexations.13.2 Members will always be informed in advance about such adjustments to membership fees.13.3 Increases in the membership fee based on the Consumer Price Index or directly resulting from national legislation, such as a VAT/IVA increase, do not give the right to terminate the membership.

Article 14: Address Changes

14.1 Members are obliged to immediately and on their own initiative notify OrO Gym of any changes in their personal information, including address, email address, telephone number, and bank account number.14.2 In case of failure to report these changes, correspondence sent to the last known address of the member according to Art. 3:37 paragraph 3 of the Civil Code is considered legally delivered, regardless of actual receipt by the member.

Article 15: Mobile Phone

15.1 Members are allowed to carry a mobile phone in the gym solely for the use of music during sports activities.15.2 Making phone calls, photographs, videos, or sound recordings is not allowed in the fitness area, studios, wellness area, and changing rooms to ensure the peace and privacy of all members.

Article 16: Prohibited Substances

16.1 The use of or being under the influence of alcohol and stimulants within OrO Gym’s facilities or during activities organized by OrO Gym is strictly prohibited.16.2 Violation of this rule will lead to immediate removal from the club and termination of the membership, without the right to a refund of any prepaid subscription fees.

Article 17: (Group) Classes

17.1 Providing (group) classes, including personal training, within OrO Gym is exclusively reserved for personnel qualified and appointed by OrO Gym. Members and external parties are not allowed to offer classes or training within the club without explicit permission.

Article 18: Opening Hours

18.1 The regular opening hours of OrO Gym are set by the club and may vary. Members will be informed in time about any changes.18.2 During official holidays and specific seasonal periods, such as the summer period and Christmas holidays, adjusted opening hours and (group class) schedules may apply. Members will be informed about this.18.3 Temporary adjustments to the range of activities or opening hours do not lead to termination of the membership or to a reduction or refund of subscription fees.

Article 19: Compliance with the House Rules

19.1 Members must comply with the instructions and the House Rules as established and communicated by OrO Gym’s management. Members agree to adhere to these rules at all times.19.2 The rules and instructions particularly relate to hygiene, order, and safety within the club, to ensure a safe and pleasant environment for all members and staff.19.3 Non-compliance with the House Rules or failure to follow instructions may lead to denial of access to the club or immediate termination of the membership, without exemption from the payment obligation for the remaining term of the membership.

Article 20: Own Risk

20.1 Members participate in sports activities and use OrO Gym’s facilities entirely at their own risk. Members are responsible for any damage, injury, or loss of property resulting from their activities within the club.20.2 Members are liable for any damage they cause to the property of the club, other members, or third parties within OrO Gym’s facilities.20.3 The member acknowledges the inherent risks of physical activity and sports practice and takes responsibility for any consequential damage resulting therefrom.20.4 The use of shower rooms and saunas is at the member’s own risk. Members should take appropriate precautions, such as wearing slippers, to prevent personal injury.20.5 OrO Gym is not liable for loss or theft of personal property of members within the club. Members are advised not to leave valuable items unattended.

Article 21: CCTV and Camera Surveillance

21.1 OrO Gym uses a CCTV/camera system in and around the club (with the exception of changing rooms, showers, and saunas) to promote safety, maintain order, and protect property.21.2 By becoming a member and/or entering OrO Gym’s facilities, the member agrees to the possibility of being recorded by this camera system.21.3 Recordings are used solely for security and incident handling and may be shared with competent authorities in the event of (suspected) unlawful acts.21.4 OrO Gym will not retain footage longer than necessary for the purposes described in this article, in accordance with applicable laws and regulations.21.5 Requests for access to or information about recordings will be handled in line with applicable privacy legislation and OrO Gym’s Privacy Policy.

Article 22: Promotional Filming and Publicity

22.1 From time to time, OrO Gym may capture photo and video content in and around the club for promotional purposes, including but not limited to publication on the website, social media channels, newsletters, and (digital) advertisements.22.2 By becoming a member and/or entering OrO Gym’s facilities, the member grants permission to appear, whether identifiable or not, in such promotional materials, without entitlement to compensation.22.3 OrO Gym respects members’ privacy. If a member does not wish to be filmed/photographed, or requests removal/anonymization of published material, they may notify OrO Gym via  info@oro-gym.com . Where reasonably possible and without disproportionate effort, OrO Gym will accommodate such requests.22.4 No promotional recordings will take place in changing rooms, showers, or saunas.22.5 This article does not limit OrO Gym’s rights in relation to content it creates.

Article 23: Privacy

23.1 OrO Gym processes personal data, including but not limited to membership data and camera footage, in accordance with applicable privacy laws and its Privacy Policy available on the website.23.2 Questions or requests regarding personal data can be sent to  info@oro-gym.com .23.3 Where required by law, OrO Gym may request identification to verify the identity of the requester and may charge a reasonable fee for excessive or unfounded requests as permitted by law.

Article 24: House Rules

General

·       Rules apply in and around the Club. These can be found on our website. By entering the Club, you agree to these rules.

·       Management reserves the right to refuse access and terminate a membership without stating reasons.

·       Upon entry, you must always report to reception for a validity check of your access App. Access is not possible without your access App.

·       Carrying (sports) bags into the sports areas is not allowed.

·       Leaving belongings in the clothing lockers is not allowed. In case of possession of a private locker, OrO Gym reserves the right to open it.

·       Smoking is strictly prohibited. The Club is completely smoke-free, except for the designated exterior smoking area.

·       Consuming meals and/or drinks brought from home in the OrO Juice Bar and/or terrace is not allowed. Water is available throughout the OrO Juice Bar and is highly recommended.

·       In the training areas, drinking is only allowed from a sealable bottle.

·       Lost items are stored for 31 days in the designated bins. Afterwards, these are donated to charity.

·       Using the Club is entirely at your own risk.

·       Management is not liable for theft, loss, or accidents in and around the Club.

·       In cases not covered by these regulations, management will decide.

·       The Club uses CCTV/camera surveillance for safety and order. By entering, you agree to the possibility of being recorded.

·       From time to time, promotional photo and video recordings may take place for channels such as social media. If you prefer not to appear, please inform staff upon entry or email  info@oro-gym.com . No recordings are made in changing rooms, showers, or saunas.

Opening Hours

·       See the website for current opening hours.

·       Opening hours are subject to change. Different opening hours may apply on public holidays.

Fitness Room and Studios

·       Wearing clean sports attire, non-marking clean (indoor) sports shoes, and using a clean towel are mandatory. Slippers are not allowed, except in the yoga/pilates studio and in the wellness area and locker rooms.

·       The use of sports shoes with black soles is not allowed.

·       Wearing a hood or bodybuilding tank top is not allowed.

·       It is mandatory to use a towel on the equipment for hygienic reasons.

·       Weights and materials must be put back in their place after use. Avoid unnecessary noise and be considerate of other members.

·       Making phone calls in the sports areas is not allowed. For phone calls, please go to the Juice Bar.

·       Taking pictures or videos that infringe on the privacy of others is not allowed.

·       Do not unnecessarily occupy equipment for a long time and do not use multiple devices at the same time.

·       Equipment must be cleaned after use with the cleaning agents provided by OrO Gym.

·       The air conditioning is operated exclusively by staff.

·       Stick to the class times and be aware that a class may be cancelled.

·       After use, cycling bikes must be cleaned and set up for the next user.

Wellness

·       Opening hours: The Wellness is accessible during fixed opening hours. All members must leave the Wellness 15 minutes before the club closes.

·       Accessibility: Only members and their registered guests have access to the Wellness.

·       Hygiene: For health and hygiene reasons, it is mandatory to shower before using the Wellness. Underwear is not allowed.

·       Use of towel: Use of a towel is mandatory both in the saunas and on the loungers. Slippers are not allowed in the sauna and steam cabin.

·       Behavior: Rest and relaxation are appreciated in the Wellness. It is not allowed to behave disruptively or talk loudly.

·       Mobile phone: Not allowed.

·       Safety: Use of the Wellness is at your own risk. Always follow the instructions of OrO Gym staff.

·       Health: Persons with contagious diseases, open wounds, or skin rashes are not allowed to enter the Wellness. The use of alcoholic beverages and entering the Wellness under the influence of alcohol or drugs is strictly prohibited. Bringing food is not allowed in the Wellness.

·       Personal belongings: Leave valuables in the locker room lockers. The club is not responsible for lost or stolen items.

·       Violations: In case of violation of these rules, access to the Wellness may be denied. In serious cases, membership may be reviewed.

·       With these rules, the Wellness remains a place of peace, safety, and exclusivity, as you would expect in a luxury sports club.

Safety

·       Use a locker for your belongings, operated with the same app you use to access the club.

·       For everyone’s safety and health, it is advisable to follow staff instructions and advice.

·       New members should report to an instructor and schedule an intake at reception.

·       If you have health problems and/or injuries, it is advisable to inform the instructor.

·       In case of doubt about participating in an activity or performing an exercise, seek advice from the instructor.
